Resumo
The ability of psychiatric patients to decide on their health is a controversial issue due to the numerous situations in which the disease can alter that competence. Current laws allow mental health professionals to decide at any time whether the patient's preferences can or should be taken into account, leading to differences between medical actions as well as numerous violations of patients' rights. The objective of this review is to analyze the factors that make possible and perpetuate this problem and propose new ways that could guarantee that the patient´s capacities are valued in an adequate way and are respected, in case they are preserved
